CHARGES FOR ASSISTING IN MOTORING OFFENCES
Fees for assistance with summary only motoring offences under Part 1 of the Road Traffic Act 1988 and Section 89 of the Road Traffic Regulation Act 1984.
All such work is undertaken by our Mr David Charman, a Senior Solicitor-Advocate.
He charges a fixed fee of £75-£100 plus VAT for an initial interview.
IF HE IS INSTRUCTED TO REPRESENT YOU ON A GUILTY PLEA HE WILL CHARGE A FURTHER FIXED FEE OF £195 PLUS VAT.
These fees include the following:-
- Taking your instructions for up to 2 hours
- Considering evidence
- Advising in relation to plea and sentence
- Representation at a single hearing for plea and sentence
- Advice on Appeal against sentence
We anticipate that this may take approximately 2-3 hours in total.
THESE FEES DO NOT INCLUDE THE FOLLOWING:-
- Additional hearings, which are charged at a further fixed fee of £195 plus VAT
- Supplementary applications such as exceptional hardship/special reasons/Newton hearings
- Instructing expert witnesses, including medical experts who may charge up to £2,500
- Additional work will be charged an hourly rate of £195 plus VAT
- The cost of time and mileage travelling to Courts outside of Leicester (mileage charged at 44p per mile)
THE KEY STAGES OF YOUR CASE, ASSUMING A GUILTY PLEA, ARE AS FOLLOWS:-
- You will meet Mr Charman to provide instructions as to what happened
- He will consider initial disclosure from the prosecution, any other evidence and advise
- He will explain Court procedure to you so that you know what to expect at the hearing and the sentencing options available to the Court
- He will obtain any further instructions from you and conduct any further preparatory work
- He will attend Court on the day of the hearing and meet you before the hearing starts. It is impossible to predict how long we will be engaged at Court.
- He will discuss the outcome of the hearing with you
TIMESCALES
As a general rule your case is likely to take 8 weeks (approx.) from your receipt of the Summons to the conclusion
WHAT IF THERE IS A ‘NOT GUILTY’ PLEA?
The costs of the initial hearing will still be as stated above (in the guilty plea section).
The cost of the trial will depend upon whether issues are factual or technical, their complexity and the length of the trial, and are likely to fall between £750 and £3,500 plus VAT.
The hourly rates quoted above (£195 plus VAT) will apply unless the fixed fee applies; Legal Aid may be available in respect of a Not Guilty plea.
